Have you recently registered a company in California? Are you thinking of forming a new company in California? If so, you will most likely need to apply for, and obtain an EIN number. EIN stands for “Employer Identification Number”. It is also known as FEIN – the Federal Employer Identification Number.

Banks, vendors, contractors, and others that you do business with may ask you for your Federal Tax Identification Number, this is the nine-digit number assigned by the Internal Revenue Service.

It doesn’t matter if you are forming a new California Corporation or registering a California Limited Liability Company (LLC) – the next step after this is to obtain your California EIN number.

Disclosure: Our goal is to feature services that we think you will find interesting, useful, and will save you a lot of time. Purchasing through a link may result in us earning a small commission at no additional expense to you.

To obtain your EIN number in California you have to know how to complete an SS4 form and submit it to the Internal Revenue Service (IRS). If you are comfortable filling out forms, specifically government ones, then you may be able to successfully complete and submit form SS4 yourself to obtain your EIN number California.

There is a link to the online process further down the page. If you want to go straight to the online process, you can click HERE.

However, most people that don’t like filling in forms (and let’s face it, who does), or simply do not know what needs to be entered on an SS4 form prefer to use the services of a company that specializes in obtaining your EIN number for your California company. This makes life so much easier, it ensures your form is not rejected by the IRS and means that there is one less thing to worry about when forming your new company and getting your California EIN.

Learn How to Get an EIN Number in California

The process through which you obtain your California EIN can seem a daunting task at first, but if you know what you are doing and follow these instructions, or if you decide to hire a specialist company to apply for your California EIN, the task of receiving your EIN number in California becomes a much more seamless and simplified process.

Navigating US government forms and making sure you complete them correctly is not easy, and if it is not something you are comfortable with or have not done before, we strongly recommend using the services of a professional document filing service, and someone that is a registered agent for the IRS to help you.

If you are a foreign national and do not have a U.S. social security number or legal residence in the U.S., the process is much more challenging if you try to do it on your own. However, as a foreign national, you can still obtain a California EIN for your business without a social security number or a TIN (tax identification number).

Once you have been issued your California EIN, the IRS will send you a notification that you will receive in the mail. This is your official California EIN confirmation.

After receiving your EIN number for your California company, you are now in a position to open up a business bank account. To open a corporate bank account, you will need to take your California certificate of incorporation or LLC registration along with your new California EIN notification that you received from the IRS.

The bank of your choosing will need to make a copy of both original forms, and you should also take your photo ID and anything else they ask you to bring. If you do not have a U.S. driver’s license, a passport will usually suffice.

How to Get Your California EIN

The other challenge most people run into is that the process you have to go through (when applying yourself) to get your California EIN has to be done online and you have to apply for your EIN in one session. What does this mean? Well, if you go to the EIN Online IRS Page, you will have to fill everything out in 15 minutes or less otherwise your session will end and you’ll have to start the process all over again.

If you are a foreign national and do not have a U.S. social security number and are not a legal resident of the U.S., then you cannot apply online, you must print the SS4 form and fill it out first.

If this all sounds quite difficult and stressful for you, then you should seriously consider having a professional document filing company take care of your California EIN for you for an affordable (fixed) fee.

Ultimately, it will save you time and money, and also a lot of anguish. Additionally, these companies are usually enrolled agents with the IRS who have earned the privilege of representing you before the Internal Revenue Service through either passing a three-part comprehensive test or through experience as a former IRS employee.

I am a Foreign National – How do I Get an EIN Number in California?

This is a question that gets asked often and there is a lot of misinformation out there. Many foreign nationals are advised that if they do not have a U.S. social security number, that they cannot apply for a California EIN.

This is not true, but what is true, is that you cannot apply for a California EIN in the same way that a U.S. citizen can or someone with a U.S. social security number can. The process is different. If you are a foreign national, please do not try to go through the online process on the IRS website – it will not work.

If you are going to try and apply for a California EIN yourself, which as we’ve previously mentioned, has its own challenges, then you must download the SS4 application form (a link for this is further up the page), and fill the form out first. Once completed, you must either call the IRS and apply by telephone, reading off the information you have filled in on the SS4 form, or you can fax or mail the form to the IRS. IRS Fax numbers and addresses are at the bottom of this page.

Neither of these scenarios is ideal because getting hold of the IRS on the phone is not always the easiest thing to do (if you are overseas you also have time zone issues to deal with), faxing can be a challenge because fax machines are rarely used nowadays, and sending forms in the mail can take a long time and you run the risk of your SS4 application being “lost in the mail.” In addition to this, you will find yourself having to chase up the IRS to find out the status of your application, and it can be a tedious and frustrating process.

The easiest, quickest, and simplest way for a foreign national to apply for an EIN Number in California is to use the services of a professional document filing company, that for an affordable (one-time) fee they will take care of everything for you.

These companies are doing this all the time and specialize in helping foreign nationals and will fax your SS4 form and application directly to the IRS, handle all the communication back and forth with them, chase them if there are any delays or issues, and mail you the original forms once they are received from the IRS. Whether you are in the U.S. or overseas, the document filing company will ensure you receive your original documents in a timely manner

The service is a complete “no-hassle” process and you will have your California EIN in no time (usually within a few weeks). You can then open your business bank account and get your business up and running.

SS-4 Fax Number

Cincinnati, OH 45999

Federal Employer Identification Number (EIN) / Tax ID Number

Where & When You'll Use an EIN

Your EIN is necessary for several situations in running your business. You will need to use your EIN for certain tax forms, such as filing your tax returns for your business, and filling out W9 forms for clients (if you run a service business), and other forms related to managing payroll for your employees. Your EIN is also necessary to set up a business bank account and apply for business loans. The same types of reasons for needing a Social Security Number in your personal life are also the reasons to use an EIN in managing your business.

How Do You Get an EIN? Apply for an EIN Online

Business owners can get an EIN by filing IRS Form SS-4. Incfile offers a convenient service to help you apply for an EIN online to obtain your EIN number quickly and efficiently. If you're looking for a way to get an EIN, whether in Texas, Florida, Michigan or anywhere in the United States, Incfile can provide one for you in one day. How to Get a Business Tax ID

4 Min. Read

Are you a business that employs workers, withholds taxes or operates as a corporation or partnership? If so, the Internal Revenue Service (IRS) agency requires you to get an Employee Identification Number (EIN), also referred to as your business tax ID number. Just like your social security number, each EIN is unique. This number allows the IRS to identify your business and requires you to provide all your tax documents and forms on it.

Fortunately, the IRS makes it really simple to obtain a new EIN. Just follow these four steps to obtain your business tax ID number.

Determine if you need an EIN

As stated before, if your business employs, withholds taxes on the wages and salaries or operates your business as a corporation or partnership, the IRS will require you to get an EIN number. An EIN is also needed for estates, trusts and non-profit organizations to name just a few.

If you operate a sole proprietorship you can still obtain an EIN and use it in the same way even though it’s only required if you have employees.

FreshBooks users get paid 18 days sooner.

Apply For Your EIN

While you are able to apply for EIN by fax, phone or mail, the IRS prefers that you apply online. You can receive your EIN right away when you complete a short application online. Go the IRS website to access the EIN Assistant page and click on “Begin Application” at the bottom to start your application process.

Answer Five Questions

It will first ask you to select the type of EIN you are applying for such as a sole proprietorship, corporation, LLC, partnership or estate. Then you need to choose the option that best describes why you are applying for a new EIN. This can be to start a new business, for banking purposed or for a range of other reasons. The online questionnaire then requests your Social Security number before you can finish your application.

Save The Document With Your EIN

After all sections of the application are completed, the system will generate you a new EIN that you can start using immediately. You will receive an official IRS document that confirms your application was successful and provides your EIN. Save a copy on your computer and print one out for your records.

Some online companies that provide incorporation services also include a service for obtaining an EIN and often charge $75 or more for it. However, you can also apply for EIN number for free by yourself. To apply, all you need to do is fill out IRS form SS-4 or file online. The IRS does not charge any filing fee to obtain an EIN or business tax ID number.

Do You Have to Have a Business License to Get a Tax ID Number?

Getting a business license and taxpayer identification number or employer identification number are two important basic requirements when starting a new business. However, they have very little to do with one another. In many jurisdictions, you could get either one first or go for both at the same time. In other places, you might have to start with the TIN or EIN before you get a business license.

One of several steps most businesses will need when starting a business in California is to register for an Employer Identification Number (EIN) and California state tax ID numbers.  These numbers are most commonly used to register a business with the federal and state government in order to pay sales taxes, payroll taxes, and withhold taxes from employee wages.

Let’s review in more detail what this number is used for when it is required, the cost, and how to register.

What is the Employer Identification Number (EIN)?

EIN is short for Employer Identification Number and is sometimes referred to as a Federal Employer Identification Number, FEIN, Federal Tax Identification Number, or Federal Tax ID Number. This is a unique nine-digit number that is similar to a social security number for an individual but instead identifies a business.

The EIN is primarily needed to hire employees, as the EIN is used as the account for paying payroll taxes, income tax withholdings, and unemployment taxes.

Some other uses of the EIN include:

  • Opening a bank account – Banks need an EIN (or SSN if the EIN isn’t needed) before opening a business bank account.
  • Applying for business licenses & permits – Most California business licenses and permits will require the EIN (or SSN in some cases) before registering the business.
  • Filing tax returns – To file taxes at the state and federal level, the EIN is used to identify the business.

Who needs an EIN?

The EIN is needed for California businesses that are either:

  • Registered as a partnership, corporation, or multi-member Limited Liability Company, or;
  • A sole proprietorship or single-member LLC that has employees

The EIN is optional for sole proprietorships and single-member LLCs without employees. Those business entities will use the owner’s social security number (SSN) or Individual Taxpayer Identification Number (ITIN). While it’s not required, using an EIN in place of the owner’s SSN can help protect the owner from identity theft.

How to apply for an EIN

The easiest and fastest way to apply for an EIN is to visit the Internal Revenue Service (IRS) website, between the hours of 7 am – 10 pm EST, Monday – Friday.

The online application process only takes about 5 minutes to file the EIN online, and the number will be ready in seconds. If applying online isn’t an option, you can also complete an EIN application by mail or fax by sending Form SS-4 to the IRS fax number 855-641-6935.

You can even get an EIN over the phone if the company was formed outside the U.S. by calling 267-941-1099. If filing by phone, note that it isn’t a toll-free number.

There is no cost to apply for an EIN.

What Information Do I Need to Get an Employer Identification Number?

Applying for an EIN is pretty straightforward, but you will need to obtain some information beforehand, such as:

  • Legal name of the business
  • Business address
  • Name(s) of the principal officer, manager, or owner
  • Name(s) and contact information of the owners, directors, officers, or members
  • Type of business and what activities the business performs
  • Date the business was started or acquired
  • Closing month of the entity’s accounting year
  • Number of employees expected to be hired
  • Contact information

Within seconds, the IRS will provide the EIN that can be used immediately. A few weeks later, the IRS will send the official paperwork, known as an EIN Confirmation Letter (CP 575).

Is an EIN the same as a tax ID number?

In addition to registering the EIN, many businesses will also need to get state of California tax numbers in order to pay for a variety of state business taxes.

Business tax numbers in California are often confused with the Employer Identification Number.  The EIN is a separate number that is used to federally register a business with the Internal Revenue Service (IRS) and may be needed in addition to state tax numbers.   The most common reasons a business in California will need to register for a state business tax numbers include:

  • Sales Tax – Businesses selling products and certain services are required to collect sales taxes and will need to register with the California Department of Tax & Fee Administration. Learn more about registering for a California sales tax number.

How to Get an EIN from Outside the U.S.

An EIN (Employer Identification Number) is also referred to as a Federal Tax ID Number. When you do business in the U.S., you can use this number to identify your company and file taxes. If you need to get an EIN from outside the U.S., the process is pretty straightforward and outlined below to help get you started.

EIN documents

First, Determine if You Need an EIN

In the United States, every business is required to have an EIN. This unique number, which is issued by the federal government, is used by the IRS in order to quickly and easily identify each business for tax purposes.

Once your business has been legally registered, you can apply for an EIN, and the IRS will use your company’s EIN to track your business income taxes, as well as to receive the taxes that you are required to pay.

If you are not a U.S. citizen and you’re located outside of the United States but you’re doing business in the country, such as running an e-commerce storefront or selling on Amazon, you need to go through the appropriate steps to get your EIN and report your earnings.

If you don’t have an ITIN (Individual Taxpayer Identification Number) or SSN (Social Security Number), your EIN will be used instead. Plus, if you are importing goods into the U.S., you will need to show an EIN if you don’t already have an ITIN or SSN. This number will also help you avoid the complex forms from U.S. Customs and Border Protection.

Here are a few reasons why your business would need to file for an EIN:

  • You’re operating your business as a partnership or corporation.
  • Your business has employees.
  • Your business withholds taxes on income that’s paid to one or more non-resident aliens.
  • You have a Keogh plan, which is a retirement plan for those who are self-employed
  • You file any of the following tax returns: Excise, Employment, and Alcohol, Tobacco and Firearms.
  • Your business is involved in any of these types of organisations: estates, trusts, non-profit organisations, real estate mortgage investment conduits, plan administrators, and farmers’ cooperatives.
  • You’re importing goods to the U.S. such as for sale on marketplaces like Amazon. Customs require an EIN when goods are valued over a certain amount or if you ship them to the U.S. by sea.
EIN, mobile, laptop

You Shouldn’t Have to Pay to Get an EIN

According to the IRS, getting an EIN for your business should come at no cost to you, as they offer the service for free. Therefore, if you come across any websites or advertisements that claim they can get you an EIN for a fee, it is best to avoid those offers and go directly through the IRS instead.

How to Get an EIN from Outside the U.S.

To obtain an EIN as an international applicant, you must call the IRS at 267-941-1099 and press the appropriate number from the menu to receive a foreign EIN. Just be aware that this isn’t a toll free number, and the hours of operation are from 6:00 a.m. to 11:00 p.m. Eastern Time. The office is open Monday through Friday only. Also be aware that this call could take quite a bit of time, so be sure to set aside at least an hour of uninterrupted time in your day to wait on hold and speak with a representative.

If you are going to make this call, make sure that you are authorised to get the EIN (either as the owner of the business or as a Third Party Designee who has been authorised to act on behalf of the business). You will also need to be able to answer questions related to Form SS-4, which you can get by visiting the IRS website and searching for the Application for Employer Identification Number.

Prior to the call, you should fill out the Third Party Designee section of the form if you wish to authorise someone else to receive your business’s EIN and answer the required questions on your behalf. Otherwise, you can leave that section of the form blank. Remember to fill out the signature area, as the authorisation will not be valid without it.

Form SS-4 asks questions regarding your business, including its U.S. mailing address, the type of entity that your company is, your reason for applying for an EIN, and the industry you work within. Completing these questions in advance will allow you to have the answers during your phone call, saving you time, but also be prepared for additional enquiries.

At the end of your call, you will be issued an EIN, which you can start using right away. Be sure to write the number down and keep it in a safe place, as your physical copy will come in the mail to your U.S. address a few weeks later. If you don’t have a U.S. address, ask the representative if they will mail the EIN internationally or send it via email.

Paying Taxes After Receiving Your EIN

Once you have your EIN, you can then pay the appropriate taxes that you owe to the federal government for doing business in the United States. To do this easily from abroad, you can pay your taxes online. Keep in mind that there are tax treaties in place to prevent double taxation, but it’s still wise to speak to an international tax expert to ensure your business pays the right tax to the right jurisdication.

After you have calculated the taxes that you owe, you can submit them via an international money transfer through OFX to save on exchange rate margins and fees.

EIN documents

Cancelling Your EIN

Once your business has received an EIN, the IRS won’t be able to cancel it, as it will become the company’s federal taxpayer ID number indefinitely, even if you never use it to file your tax returns. Your unique EIN will never be reassigned or reused by being issued to another business entity. So if you don’t end up using your EIN in the near future, it will always be there if business picks up later on.

However, according to the IRS, if you do get an EIN but you determine later on that you don’t actually need it, the agency could close your company’s account. You would need to send the IRS a letter that contains the legal name of your business, along with its address, its EIN, and the reason you want to close the account. Before your account can be closed, you must pay all of the taxes that you owe.

Conduct Business in the U.S. From Abroad

Customs require an EIN when goods are valued over a certain amount or if you ship them to the U.S. by sea.
