The Liberty Flames and Eastern Michigan Eagles will face off in the 2021 LendingTree Bowl, per Brett McMurphy. The game will take place at Hancock Whitney Stadium in Mobile in Mobile, Alabama. Kickoff is currently scheduled for 5:45 p.m. ET on Saturday, Dec 18, 2021. The game will air on ESPN and will be available via live stream at WatchESPN.

Hugh Freeze continues to show he can coach college football very well as the Flames are headed to a bowl game for the third consecutive season in his three years at Liberty. Quarterback Malik Willis continues to get a ton of love from the NFL Draft community. The Auburn Tigers transfer played his second season as a starter and completed 61.6% of his passes for 2,626 yards with 24 touchdowns and 12 interceptions. The Flames have also played very well defensively as they ranked inside the top 15 in opponent yards per play heading into conference championship weekend.

The Eagles are bowl eligible for the third year in a row, not including a six-game season in 2020. Eastern Michigan continues to be a solid MAC program under Chris Creighton, who is in his eighth season and successfully rebuilt the team to being competitive in the conference. Ben Bryant completed 68.8% of his passes for 2,921 yards with 14 touchdowns and six interceptions this season, though the defense has struggled as they rank outside the top 100 in opponent yards per play.

Fraternity in sex assault reports breaks with Eastern Michigan, cites ‘kangaroo court’ fear


The local chapter of the Alpha Sigma Phi fraternity, amid a school review, has chosen to break with Eastern Michigan University — and the school and the frat have come out swinging as to why.

When addressing its response to numerous reports of sexual assaults, the school last month revealed the fraternity was one of two under review for complaints; the school is fighting federal lawsuits accusing it of mishandling reports of sexual assault, and a former Alpha Sigma Phi member, Dustyn Durbin, was charged last year with sexually assaulting nine women during his time there.   

The local chapter chose last week to dissociate — untethering itself from university involvement, though it will still operate and recruit students — “rather than participate in the University’s review of its policies and practices, and adhere to required protocols for affiliation with EMU,” Eastern Michigan University President James Smith said in a message to the community Monday.

It means that though EMU remains “deeply concerned about their activities” it will no longer be able to provide oversight and intervene in the chapter, Smith said. It also means the fraternity cannot use EMU resources or its name.

“It is clear from the fraternity's actions and decisions that the leadership of ASP and its members no longer elect to abide by University standards and guidelines for student groups,” he said. “People who are concerned about ASP's operations should contact the national headquarters of Alpha Sigma Phi to voice those concerns or, if they observe illegal activity, contact 911.”

However, the national chapter quickly snapped back, with Gordy Heminger, president and CEO, saying in emails Monday evening that the fraternity would have been happy to participate in the review, but it had questions about the process that school employees couldn’t answer.

“Unfortunately, those questions were never answered, leading us to believe the University was making this process up on the fly and the chapter was not going to participate in a kangaroo court where basic due process protections were not provided,” Heminger said. “It appears that this organization review process was a ploy by the University to take attention away from the apparent failures of the Title IX office to support the survivors of sexual assault at Eastern Michigan.

“To be very clear – Alpha Sigma Phi and the chapter support the survivors and believe anyone found responsible for committing sexual assault should be suspended from Eastern Michigan and go to prison,” he said.

Heminger also provided an email sent to EMU leaders from the fraternity announcing the chapter's departure as a student organization. In it, the fraternity claimed that over the course of 10 months, the school showed it had no intention of supporting the chapter and: 

  • Aims “to scapegoat the fraternities for their own negligence in student adjudication, and sanction students (via the chapter) who were not even in college when the events occurred.”
  • Created the “organizational review” to specifically target Alpha Sigma Phi and the other fraternity. (Heminger also said the fraternity was never told the review involved sexual assault and information requested by the school did not involve sexual assault.)
  • In spring 2021, issued an interim suspension for longer than allowed under the Code of Conduct. The reasons for the suspension are not listed in the email, but Heminger said it was related to COVID-19 and a service project, and the chapter was found not responsible. 
  • Told the chapter to just contact Ypsilanti police as it endured vandalism and harassment.

The email states fraternity members aided survivors reporting to police and the chapter expelled Durbin when it learned of the charges against him; the Free Press has reported he was a graduate at the time.

“To date, Alpha Sigma Phi has done more than Eastern Michigan University to protect survivors and create a safer community,” the email said. “Alpha Sigma Phi has done our part. You have not and rather than create systemic change within your community, you have spent valuable time and resources creating an organization review.”

The school has stood by its handling of sexual assaults and Title IX cases, and EMU Vice President of Communications Walter Kraft, in emails Monday night, countered the fraternity claims. He said the school asked only that the chapter follow practices that every other student organization follows, and said the chapter was not suspended.

"The allegations made against the University by Alpha Sigma Phi (ASP) are just plain false," he said, later adding: "In the current review, we didn't ask ASP anything different than we asked the other fraternity, which is complying with the review."

He also noted dissociation is not new for the Alpha Sigma Phi; MLive reports it did so at the University of Michigan, along with others, in 2018 related to a change in rush and zoning. Then came discipline for hazing. 

"This is clearly an example of a group that is determined to operate independently without the appropriate oversight of the University into its practices. ... We are well within our rights to review the actions of associated student groups, especially in order to maintain the safety of our campus community," Kraft said.

Alpha Sigma Phi is also a defendant alongside the school in a federal lawsuit filed by reported survivors of sexual assault, and the fraternity was slated for mediation last week. The mediation process is ongoing, Heminger said.

Another fraternity tied to men’s criminal cases and being sued is Delta Tau Delta, which is slated for mediation in October or November.

That fraternity is also under review, but has “complied with and participated in the review process to date,” Smith said in his message.

Smith said the review is moving forward vigorously and that the school hopes to release more on the status of the review in the coming weeks.

"We must follow University processes and procedures in completing this review, which may take a little longer than people wish," he said. "It is our utmost priority, as well as my pledge to the campus community, to complete this review and report back on the outcome and determinations."

The school previously announced a slew of new and renewed efforts to prevent sexual assault.

On Monday, Smith said one of those efforts was sent out last week in the form of mandatory online training on Title IX, bystander intervention and prevention. It must be completed before students can register for the winter semester. 

Additionally, a Survivors Handbook is being developed, an EMU Faculty/Staff Title IX Resource will be printed in the coming weeks, and data from a “Final Report on the EMU Campus Survey on Sexual Misconduct Culture” will be incorporated into strategic planning efforts.
